“Playtex Infant Monthly Sweepstakes” Contest
OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY. YOU HAVE NOT YET WON. OPEN TO LEGAL RESIDENTS OF CANADA WHO HAVE REACHED THE AGE OF MAJORITY IN THEIR PROVINCE/TERRITORY OF RESIDENCE. VOID OUTSIDE CANADA, ELSEWHERE AND WHERE PROHIBITED. FOR ENTRY DETAILS, SEE OFFICIAL RULES BELOW BY WHICH ENTRANTS ARE BOUND.

CONTEST PERIOD. The “Playtex Infant Monthly Sweepstakes” (the “Contest”) commences at 12:00:00 am (ET) on January 1, 2012 and ends at 11:59:59 PM (ET) on October 31, 2012 (the “Contest Period”). A Month is defined as commencing at 12:00:00 AM (ET) on the 1st day of a Month and ending at 11:59:59 PM (ET) on the last day of a Month (a “Contest Month”). To be eligible for a Monthly Prize (as defined in Rule 5 below) entries must be received between 12:00:00 AM (ET) on the 1st day of the Month and 11:59:59 PM (ET) on the last day of the Month (the “Monthly Contest Closing Date”).There will be a total of ten (10) Monthly Contest Closing Dates during the Contest Period. See Rule 6 for further details. A Contest Day (a “Contest Day”) is defined as each day during the Contest Period starting at 12:00:00 AM (ET) and ending at 11:59:59 PM (ET).
ELIGIBILITY: To enter the Contest and be eligible to win a Monthly Prize, a person (“Entrant”) must be, at the time of entry into the Contest and at the time of awarding the Monthly Prize: (a) an individual legal resident of Canada, (b) located in Canada, (c) of the age of majority in his/her province or territory of residence. Employees, officers, and directors (including members of the same household of such persons whether related or not) of Energizer Canada Inc. (the “Sponsor”), its affiliates, agents, participating stores, advertising or Contest agencies, and the independent contest organization are not eligible to enter the Contest. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant, should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
HOW TO ENTER: No Purchase Necessary.

2. Already a member: Review and confirm your personal information, correctly answer without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing and select “Submit”. Upon receipt you will receive a “Thank you for entering” message.
3. New members: If you would like to start receiving newsletters via email regarding future Contests, coupons, specials, and product information, complete the online entry form with your full name, province, daytime telephone number, email address, create and confirm a password, select your age range , correctly answer without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing and select “Submit”. Upon receipt you will receive a “Thank you for registering” message and will be asked if you would like to enter the Contest. Click “Yes” and select “Submit”. Upon receipt you will receive a “Thank you for entering” message.
4. Enter without becoming a member: To enter the Contest complete the online entry form with your full name, province, daytime telephone number, email address, age range, correctly answer without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing and select “Submit”. Upon receipt you will receive a “Thank you for entering” message.
LIMIT OF NUMBER OF ENTRIES: A person may enter the Contest once (1) per Day during the Contest Period. A person may only use one (1) e-mail address to participate in the Contest. Any person who is found to have entered the Contest with more than one (1) e-mail address will be disqualified and all such entries received by such person during the Monthly Contest Period will be disqualified. Proof of transmission (screenshots or captures etc) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All entries become the property of the Sponsor upon receipt and none will be returned.

Prizes must be accepted as awarded without substitution and are not transferable or for resale and have no cash surrender value. The Sponsor reserves the right, in the event that a Prize or any component of a Prize cannot be awarded as described for any reason, to substitute a similar Prize or component of a Prize of equal or greater value without liability. Total ARV of all prizes: Nine Thousand, and Eighty-Four Dollars, and Sixteen Cents ($9,084.16 CDN). Odds of winning depend on the number of eligible entries received within each Contest Month.
MONTHLY DRAWS: All Monthly Prize random draws will be held on the Tuesday following the close of the preceding Monthly Contest Closing Date at approximately 10:00 AM (ET) in Oakville ON.
1. January’s Monthly Draw: January’s monthly draw will be held on February 7, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on January 1, 2012 and 11:59:59 PM (ET) on January 31, 2012.
2. February’s Monthly Draw: February’s monthly draw will be held on March 6, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on February 1, 2012 and 11:59:59 PM (ET) on February 29, 2012.
3. March’s Monthly Draw: March’s monthly draw will be held on April 3, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on March 1, 2012 and 11:59:59 PM (ET) on March 31, 2012.
4. April’s Monthly Draw: April’s monthly draw will be held on May 8, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on April 1, 2012 and 11:59:59 PM (ET) on April 30, 2012.
5. May’s Monthly Draw: May’s monthly draw will be held on June 5, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on May 1, 2012 and 11:59:59 PM (ET) on May 31, 2012.
6. June’s Monthly Draw: June’s monthly draws will be held on July 3, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on June 1, 2012 and 11:59:59 PM (ET) on June 30, 2012.
7. July’s Monthly Draw: July’s monthly draw will be held on August 7, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on July 1, 2012 and 11:59:59 PM (ET) on July 31, 2012.
8. August’s Monthly Draw: August’s monthly draw will be held on September 4, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on August 1, 2012 and 11:59:59 PM (ET) on August 31, 2012.
9. September’s Monthly Draw: September’s monthly draw will be held on October 9, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on September 1, 2012 and 11:59:59 PM (ET) on September 30, 2012.
10. October’s Monthly Draw: October’s monthly draw will be held on November 6, 2012 amongst all eligible entries received between 12:00:00 AM (ET) on October 1, 2012 and 11:59:59 PM (ET) on October 31, 2012.
Four (4) entrants will be randomly selected in each Monthly draw. Odds of winning a Prize will depend on the total number of eligible entries received during the specific Contest Month. Each selected entrant will be contacted by e-mail or telephone, within ten (10) business days of the draw date. In the event that any selected entrant cannot be contacted within ten (10) business days by e-mail or telephone, the selected entrant will be disqualified, and his/her entitlement to receive a Prize will be forfeited and an alternate eligible entrant will be randomly selected from the remaining eligible entries and the above process will be repeated until such time as contact is made with a selected entrant or there are no more eligible entrants available for the specific Month. Prior to being declared a winner, each selected entrant must have correctly answered the mathematical skill-testing question on the entry form (a “Prize Winner”). In the event that a selected entrant has incorrectly answered the mathematical skill-testing question, he/she will be disqualified and another entrant will be randomly selected and the above process will be repeated until such time as there are four (4) confirmed Monthly Winners (each a “Winner”) and/or no more entries are available for the specific Month.
RELEASE FORM: Each selected entrant must complete and return the Release Form (the "Form"). By completing and returning the Form, and accepting the Prize, the Winner confirms compliance with the Official Rules, acknowledges that the Prize must be accepted as awarded and cannot be substituted or transferred and has no cash surrender value, releases the Sponsor, its affiliated and related companies, advertising and Contest agencies, the independent contest organization and their respective shareholders, directors, officers, employees and agents from and against all liability in connection with the Contest and the awarding and use of the Prize, and consents to the use of his/her name, address (city and province) and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to this Contest. The Form must be returned within the time period specified on the Form or the Prize will be forfeited. The Sponsor or a designated agent will send within forty-five (45) days by mail or courier the Monthly Prize upon receiving the fully completed Form.
CONDITIONS OF ENTRY: By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the Official Rules and by the decisions of the independent contest organization, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules will be disqualified.
If a dispute arises regarding who submitted an on-line entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry. An "authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
GENERAL: The Sponsor and the independent contest organization do not assume any responsibility and are not responsible for: (i) the incorrect or inaccurate capture of entry information; (ii) entries which fail to comply with the Official Rules; (iii) any loss, damage, or claims caused by the awarded Prize or the Contest itself; (iv) any failure of the website during the Contest Period, including any problems, human or technical error, printing errors, lost, delayed, garbled data or transmissions, omissions, interruption, deletion, defect or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail; or on-line entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material in the Contest all of which may affect a person's ability to participate in the Contest; or (v) any other matter whatsoever. Entry material/data that have been tampered with or altered are void.
All entries are subject to verification. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to enter or otherwise participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).
In the event of a dispute regarding who submitted an entry (as applicable) will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with a selected entry and that he/she has all necessary consents, permissions and/or licenses as required by these Official Rules.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Official Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Official Rules.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, (i) the laws of the Province of Québec and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the other Canadian provinces and territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.
The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”), to withdraw, suspend or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. If you consented on the Entry Form, the Sponsor may use the information you provide to initiate, maintain, and develop a relationship with you in connection with the offering of the Sponsor’s products or the Contest and marketing of additional products and services offered by the Sponsor. You may revoke your consent at any time by calling Playtex Consumer Affairs at 1-800-387-1300. If you did not consent on the Entry Form, the information you provided will only be used to conduct the Contest in accordance with the terms of our privacy policy at http://www.energizer.ca/privacy-policy-en.aspx.
18. By entering, or otherwise participating in, this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with her entry registration (as applicable) only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: http://www.energizer.ca/privacy-policy-en.aspx), unless the entrant otherwise agrees.
INTELLECTUAL PROPERTY
All intellectual property used by the Sponsor in connection with the Contest and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, Contest materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
LANGUAGE DISCREPANCY
In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
